1. Introduction
1.1. These NDIS Participant Referral Terms and Conditions (the “Terms”) govern the process of referring individuals, referred to as “Participants,” to the National Disability Insurance Scheme (NDIS) through a referral program (the “Program”). The entity or individual making the referral is referred to as the “Referrer.”
1.2. By participating in the Program, Referrers and Participants agree to be bound by these Terms. If you do not agree with these Terms, please do not participate in the Program.
2.1. The Referrer must have a legitimate relationship with the Participant, such as a healthcare provider, support coordinator, or family member, and must genuinely believe that the Participant meets the eligibility criteria for the NDIS.
2.2. Participants must meet the eligibility criteria set forth by the NDIS to be eligible for referral through the Program.
3.1. Referrers may refer Participants to the NDIS through the methods provided by the National Disability Insurance Agency (NDIA), including submitting the necessary documentation and supporting evidence.
3.2. Participants must follow the referral process and guidelines provided by the NDIA to be eligible for the NDIS.
4.1. Referrers have a responsibility to provide accurate and truthful information about the Participant’s disability and support needs.
4.2. Referrers should keep the Participant informed about the referral process, including any potential outcomes and responsibilities.
5.1. Referrers must obtain the Participant’s consent to share their personal and health information with the NDIA for the purpose of the NDIS application.
5.2. The personal information of Participants and Referrers will be processed and used in accordance with the privacy and data protection laws and regulations applicable in the relevant jurisdiction.
6.1. The NDIA reserves the right to modify, suspend, or terminate the Program or these Terms at any time, with or without notice.
6.2. The NDIA may also reject or disqualify referrals that do not meet the NDIS eligibility criteria.
7.1. The Program is a service provided by the NDIA to assist eligible individuals in accessing the NDIS. It does not create any contractual or legal obligations between the Referrer, Participant, and the NDIA.
8.1. These Terms are governed by the laws of the relevant jurisdiction. Any disputes arising from the Program or these Terms will be subject to the exclusive jurisdiction of the courts of the relevant jurisdiction.
